We reserve the right, to the extent permitted by law, to:

  • Issue a refund for a canceled order.

This right applies even after an order has been submitted or an authorization has been placed on a payment method.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase. An automated order-confirmation email only confirms that we received the order; it does not guarantee acceptance or shipment.

An order is accepted when we approve it for fulfillment or ship the merchandise.

We may cancel or limit orders placed under the same name, customer account, payment card, billing address, shipping address, email address, or household.

Temporary payment authorizations may appear before an order is accepted or shipped. The release time for an authorization is controlled by the customer’s bank or card issuer.

We are not responsible for overdraft charges, card-issuer fees, currency-conversion fees, or other charges imposed by a financial institution.

10. Shipping and Delivery

Orders are processed according to our posted Shipping Policy.

Shipping and delivery dates are estimates and are not guaranteed unless expressly stated otherwise. Carrier delays may occur due to weather, holidays, high shipping volume, emergencies, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Ivory Rose is not responsible for delays, failed delivery, or additional charges caused by:

  • An incorrect or incomplete address;
  • Failure to include an apartment or unit number;
  • Refusal of delivery;
  • Failure to retrieve a package;
  • An inaccessible delivery location; or
  • An address change requested after fulfillment begins.

If an order is returned to us because of an address issue, refusal, or failed delivery, the customer may be responsible for additional shipping charges before the order is resent. Original shipping charges may be nonrefundable unless otherwise required by law.

Ownership and risk of loss are handled according to applicable law. Customers should contact us promptly regarding packages that are lost, damaged, or incorrectly delivered so that we can assist with any available carrier claim.

11. Shipping Delays and Unavailable Items

We make reasonable efforts to ship orders within the timeframe stated on our website or in the applicable product listing.

If we cannot ship an order within the promised timeframe, we may:

  • Contact you with a revised estimated shipping date;
  • Request your agreement to the delay;
  • Offer an alternative product;

We may split shipments when items become available at different times.

12. Preorder Items

Products identified as preorder are not immediately available for shipment.

The anticipated shipping date or timeframe will be displayed in the product listing. Preorder dates are estimates and may change due to manufacturing, transportation, customs, supplier, or carrier delays.

Unless required by law or otherwise stated in our policies, preorder purchases may not be canceled simply because the item has not shipped before its estimated date.

If a significant delay occurs, we will provide any notice, cancellation opportunity, or refund required by applicable law.

When preorder and in-stock items are purchased together, the entire order may be held until all items are available unless we choose to ship the items separately.

13. Returns, Refunds and Exchanges

Returns, refunds, store credits, and exchanges are governed by our posted Return Policy, which is incorporated into these Terms.

Customers are responsible for reviewing the Return Policy before purchasing.

Unless otherwise required by law:

  • Returned items must satisfy all eligibility requirements;
  • Return requests must be submitted within the stated return period;
  • Items marked final sale cannot be returned or exchanged;
  • Accessories and sale items are final sale;
  • Items purchased with a discount of 20% or more are final sale;
  • Original shipping charges are nonrefundable; and
  • Return-label fees may be deducted from refunds.

Ivory Rose may reject merchandise that is worn, washed, altered, damaged, missing tags, or returned with odors, stains, makeup, pet hair, deodorant, or other signs of use.

Approved refunds will generally be issued to the original payment method. Processing times may vary depending on the bank or card issuer.

Nothing in this section limits any non-waivable rights provided by applicable law.

14. Local Pickup Orders

Orders selected for local pickup must be collected within the period stated in our Local Pickup or Return Policy.

Customers must wait until they receive confirmation that the order is ready before attempting pickup.

Orders not collected within 14 days after being marked ready may become ineligible for return or refund, except where prohibited by law. We may contact the customer, cancel the order, restock the merchandise, or issue store credit at our discretion and as permitted by law.

Identification or order confirmation may be required at pickup.

15. Gift Cards and Store Credit

Gift cards and store credits:

  • May be used only with Ivory Rose through supported sales channels;
  • Cannot be redeemed for cash except where required by law;
  • Cannot be replaced if lost, stolen, or used without authorization unless required by law;
  • May not be used to purchase additional gift cards if restricted by our system; and
  • Are subject to any additional terms displayed at purchase.

Store credit issued as part of a return has no cash value and may be subject to separate conditions disclosed when issued.

16. Optional and Third-Party Tools

We may provide access to tools, applications, payment services, social-media features, or other services operated by third parties.

These services may be provided “as is” and may be governed by the third party’s own terms and privacy policies.

We do not control and are not responsible for a third party’s:

  • Availability;

  • Performance; or
  • Handling of personal information.

Your use of third-party services is at your discretion and subject to the terms imposed by those providers.

Before filing a legal claim, you and Ivory Rose agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing a reasonable opportunity to respond.

To the fullest extent permitted by law, any legal action arising from these Terms or a purchase from Ivory Rose must be brought in a state court located in St. Francois County, Missouri, or, when federal jurisdiction exists, the appropriate federal court serving that area.

Nothing in this section prevents either party from:

  • Bringing an eligible claim in small-claims court;
  • Reporting a matter to a government agency;
  • Seeking emergency injunctive relief; or
  • Exercising a right that applicable law does not permit the party to waive.

29. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted and severed only to the extent necessary.

The remaining provisions will continue in full force.

30. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
